Visit to Poland on the execution of the European Court’s judgments

On 3 and 4 October, the Department for the Execution of Judgments carried out a mission to Warsaw, organised in cooperation with the Polish Government Agent before the European Court of Human Rights.

The Department held detailed discussions with representatives from the Ministries of Foreign Affairs, Justice, Culture and National Heritage, the Chancellery of the Prime Minister, the Ombudsman for Children, the National Prosecution Service, the Border Guards, and the Prison Guards.  

The discussions touched upon short-term and long-term perspectives for the execution of the European Court’s judgments regarding the following issues: CIA secret rendition operation (Al Nashiri group); criminal defamation (Kurłowicz group); personal checks in penitentiaries (Milka group); excessive length of detention on remand (Burża group); proceedings concerning execution of contact orders (Stasik) and under the Hague Convention on Civil Aspects of International Child Abduction (K.J.); lack of remedy to challenge prosecutor’s decision on the exhumation (Solska and Rybicka); placement of families with children in guarded centres for foreigners (Bistieva group); restrictions in disposing of a former cemetery (Potomska and Potomski).

Further, a general exchange of views related to the execution of the European Court’s judgments against Poland took place with representatives of the Office of the Polish Ombudsman and with the Chair of the Sub-commission for the execution of the judgments of the European Court of the Polish Sejm.
