This balance between the right to privacy and freedom of expression becomes particularly challenging when journalistic activities involve sensitive data.
The public interest may conflict with personal privacy rights, particularly for public figures or concerning sensitive personal information. The European Court of Human Rights enshrines the right to privacy under Article 8 of the European Convention of Human Rights, which provides safeguards against arbitrary interference by public authorities unless specific, lawful criteria’s are met.
In an effort to strengthen human rights protection in Serbia, a specialised workshop on the European Court of Human Rights (ECtHR) standards on data protection and freedom of expression was held for the professional staff of the Commissioner for Information of Public Importance and Personal Data Protection. Participants studied landmark ECtHR cases, such as Hurbain v. Belgium, Axel Springer AG v. Germany and Von Hannover v. Germany, which highlights the complex balance between the right to privacy (Article 8) and the right to freedom of expression (Article 10).
The workshop covered a broad array of topics reflecting ECtHR jurisprudence, offering participants a comprehensive understanding of both the negative and positive obligations tied to Article 8. By equipping Serbia’s Commissioners’ staff with a deeper understanding of ECtHR standards, this workshop enhanced their ability to uphold the rule of law and fundamental freedoms.
This workshop was organised by the Division for Cooperation on Freedom of Expression, through the action “Protecting freedom of expression and of the media in Serbia (PROFREX)”, which is part of the joint European Union – Council of Europe programme “Horizontal Facility for the Western Balkans and Türkiye”.
