Visit to North Macedonia on the execution of the European Court’s judgments

On 20-21 November, the Department for the Execution of Judgments, with the help of the Agent of North Macedonia before the European Court, carried out a mission to Skopje to discuss the implementation of several European Court’s judgments with national stakeholders, including three Ministers.

In the meeting with the Minister of Education and Science and her team, the discussion focused on the measures underway aimed at overcoming the segregation of Roma children in education (in response to the Elmazova and Others judgment), with a particular emphasis on further amendments to the recently published draft changes to the Primary Education Law, the adoption of which is expected shortly. Representatives of the Council of Europe Roma and Travellers Division and the Education Department, previously involved in several cooperation activities facilitating the execution of this case, also participated in the meeting.

The Department further met with the Minister of Interior who presented legislative measures adopted to implement the Trajkovski and Chipovski judgment (concerning the detention of DNA profiles of convicted persons), including the relevant bylaw published in November this year.

The delegation was also received by the Minister of Digital Transformation with whom the discussion focussed on the outstanding legislative measures required for full implementation of the X judgment (concerning the absence of quick, accessible and transparent procedures in domestic law that would allow for legal gender recognition).

Another meeting took place with the newly appointed Director of Academy of Judges and Public Prosecutors who explained that a working group has been established to draft a manual to help prosecutors and the judiciary apply pre-trial detention measures in line with the European Convention (Vasilkoski and Others group). This manual is expected to be finalised by May 2025.

Finally, the delegation had meetings with representatives of the Ministry of Justice to discuss the ongoing measures to implement several judgments, including those from the Mitovi group (concerning non-enforcement of decisions concerning contact rights with children) and Mitrevska (concerning the inability of adoptees to obtain information about their biological origin) in response to which a new draft Family Law has been drafted and will be open for public consultation soon. The Ministry further explained that a new Criminal Procedure Code has been prepared which is expected to significantly contribute to the implementation of the above-mentioned Vasilkoski and Others group. Its adoption is envisaged by the end of 2025.
